By using www.Itravelportugal.com, you agree to be legally bound by these terms, which shall take effect immediately. If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use iTravelportugal.com.

iTravelPortugal may change these Terms & Conditions at any time by posting changes online. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by iTravelPortugal. Your continued use of www.itravelportugal.com after changes are posted means you agree to be legally bound by these terms as updated and/or amended. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use www.itravelportugal.com content (inclusive of text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of www.iTravelPortugal.com content requires the prior written permission of Living.

You agree to use ITravelportugal.com only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of www.itravelportugal.com. Your use of www.itravelportugal.com is intended for personal, noncommercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this site to make any speculative, false or fraudulent requests. You agree not to use robots or other automated means to access this site, unless specifically permitted by ITravelportugal. We grant you permission to use the site subject to the restrictions in these Terms & Conditions. In accessing or using the site, you may be exposed to content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. ITravelportugal does not endorse such content, and cannot vouch for its accuracy. You therefore access and use the site at your own risk.

You don’t need to create an account and provide information about yourself in order to use some of the features on the site. You are responsible for maintaining the confidentiality of your account. You are also responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account. Your account is for your personal, non-commercial use only. You may not impersonate someone else (e.g., adopt the identity of a celebrity), create an account for anyone other than yourself, provide an email address other than your own, or create multiple accounts. We reserve the right to close your account at any time for any or no reason.

Content

You can contribute to the site in a number of different ways, including writing reviews, uploading photos, filling out your public profile, and rating other users’ contributions (your “Content”).

We may use Your Content in a number of different ways, including displaying it on the site, reformatting it, editing it for clarity and grammar, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their own websites and media platforms (“Other Media”). As such, you hereby irrevocably grant us permission to use your Content for any purpose. You also irrevocably grant the site’s users and the users of any Other Media the right to access Your Content in connection with their use of the Site and any Other Media. Finally, you irrevocably waive, and cause to be waived, any claims and assertions of moral rights or attribution with respect to Your Content.

You alone are responsible for your Content. You assume all risks associated with your Content, including anyone’s reliance on its accuracy, completeness or usefulness, or any disclosure by you of information in your Content that makes you personally identifiable. You represent that you own, or have the necessary permissions to use, and authorize the use of, your Content as described herein. You may not imply that your Content is in any way sponsored or endorsed by ITravelportugal.

You may expose yourself to liability if, for example, Your Content violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is false, intentionally misleading, or defamatory; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation. We may remove or reinstate user Content from time to time at our sole discretion. For example, we may remove a review if we believe it violates our content guidelines. We have no obligation to retain or provide you with copies of your Content, nor do we guarantee any confidentiality concerning your Content.

iTravelPortugal and its affiliates may display advertisements and other information adjacent to or included with your Content on the Site and Other Media. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you.

All products, tours and services offered by ITravelPortugal are valid as per the dates displayed at ww.iTravelPortugal.com. iTravelPortugal is not responsible or liable for any information that it does not directly provide.

Organization

The organization of the tour and travel packages listed on this website is the responsibility of Portugal Positive Travel, Sociedade Unipessoal, lda and its associated suppliers.

Portugal Positive Travel, Sociedade Unipessoal, Lda is a licensed tour operator registered with Turismo de Portugal (RNAVT 11615).

Reservations

eservations for our tours listed on this website will only be considered confirmed after full payment of the agreed amount, and within the established deadlines. The deadlines are as follows:

A 10% deposit at the time of reservation confirmation

For 1-day tours: 90% of the remaining payment at the time of departure/meeting point

For 1 day tours free cancellation 24 hours before departure

For 1 day tours cancellations with less than 24 hours prior to departure or no-show, the tickets are non-refundable

Online bookings full payment must be done 24 hours before departure

For long-duration tours and trips: payment of the remaining 90% up to 10 days before the departure date

We reserve the right to cancel any reservation that does not comply with these conditions.

If the reservation is made 10 days (or less) before the departure date, the full price of the trip must be paid at the time of booking, subject to supplier confirmation.

In exceptional cases, subject to partner conditions and/or the time of year, full payment may be required at the time of booking or service confirmation. Portugal Positive Travel Sociedade Unipessoal, Lda reserves the right to cancel any reservation if payment is not made under the above conditions.

Cancellation

Cancellations requested by the client follow these conditions (except for programs involving 1 day tours:

Full refund of the amount paid if cancellation is communicated at least 30 days before the departure date.

Refund of 10% of the amount (referring to the deposit) if cancellation is requested between 30 and 7 days before the departure date.

No refund if cancellation is requested less than 7 days before the departure date.

If, for any reason, Portugal Positive Travel, Sociedade Unipessoal, lda or any associated supplier cancels the tour, the client will be informed and will receive a full refund of the amount paid.

Payment

Payment must be made according to the previously described conditions and within the indicated deadlines. For customer convenience, we offer two payment methods:

Bank Transfer: An email will be sent to the client with our IBAN, the amount due, and the payment deadline. Once payment is made, the client must send the payment proof to help identify the transaction.

Credit Card Payment: Mastercard or Visa. An email with a link will be sent to the client. To make the payment, simply click on the link, which will redirect you to a secure official payment system, without any additional charges (payment processed by RedUnicre).

Prices

Our travel prices are always quoted in Euros (€) and calculated based on exchange rates, transport fares, fuel costs, taxes, and other applicable fees. Any price variations may result in a revision of the final travel price. These changes will be communicated to the customer in writing or through any means that ensures the customer is aware of the communication.

In this case, the customer has the right to cancel the trip without any penalties. There will be no price increase within 10 days of the trip departure for confirmed bookings.

Documentation

All travelers, without exception (including children), must have their personal or family documentation in order (ID card or citizen card, passport, military documentation, minors’ authorization, visas, vaccination certificates, European health insurance card, and any other required documents). Birth certificates or records are not valid as travel documents. Citizens of countries other than Portugal must seek information on the entry conditions of the countries they will visit.

It is the travelers’ responsibility to obtain passports, vaccination certificates, etc., if required for the trip. iTravelPortugal takes no responsibility for visa refusals or denied entry to foreign countries. Any associated costs will be borne by the client. Children must always be accompanied by an adult.

Insurance

We recommend that passengers purchase life, health, medical, pharmaceutical, and baggage insurance. It is understood that responsibility for any damage to life, physical integrity, health, or passenger property lies with the insurance provider and not with iTravelPortugal.

Minimum Number of Participants

All of our programs are subject to a minimum number of participants. If the number of participants is insufficient, we reserve the right to cancel the trip, refund the amount paid, or facilitate a change to another tour. In such cases, the customer will be informed in writing of the cancellation within 10 days before the departure date.

Complaints

Complaints will only be considered if submitted in writing to iTravelPortugal within 30 days after the services have been provided. Complaints must be reported to service providers during the trip, and proper documentation proving the occurrence must be obtained. Alternative dispute resolution for consumer disputes

Alternative Dispute Resolution (ADR) for consumer disputes encompasses mediation, conciliation, and arbitration.

These are primarily Consumer Conflict Resolution Centers that resolve disputes through mediation, conciliation, and arbitration, either for free or at reduced costs. They provide free information on consumer issues and offer consumers the opportunity to turn to official entities for assistance in resolving or guiding conflicts before resorting to legal proceedings in courts.

Alternative dispute resolution is typically less expensive, less formal, and faster than the judicial process.

Travel and Tourism Guarantee Fund (FGVT)

The deadline for the submission of such an application shall be deemed to have been complied with when, in the course of the application:

​_ a complaint has been filed in the Complaints Book;

_ a complaint has been addressed, in any written form, to: the travel agency and Turismo de Portugal; or the Economic and Food Safety Authority; or the Directorate-General for Consumers; or the Municipal Consumer Information Services; or the Consumer Dispute Arbitration Centres; or the Customer Ombudsman of Travel and Tourism Agencies; or any other entity competent in the matter.

Requests for the arbitration committee to intervene are submitted through the aforementioned online form. In the event that this method is unavailable, a form in PDF format can be sent by e-mail to s.comissao.arbitral@turismodeportugal.pt​ or, alternatively, by post. // Request for the activation of the Travel and Tourism Guarantee Fund

To apply for the activation of the Travel and Tourism Guarantee Fund, the PDF form​ (PT) must be filled out and sent to avt.reclamacoes@turismodeportugal.pt, accompanied by the aforementioned decision or resolution.

Having received requests to activate the fund following decisions made by the Arbitration Committee, Turismo de Portugal I.P. shall notify the relevant travel and tourism agencies that they are to pay the amount owed within 10 days, prior to activating the FGVT.

When a payment is made by the FGVT, i.e. in cases where the travel and tourism agency or agencies in question fail to pay the amount owed, said agency or agencies must then reimburse the FGVT for the amount paid out no later than 15 days from the date of said payment.
